TRANSPORTATION LAW

Transportation Law is a branch of law that regulates the legal relationships that arise during the transportation of goods or people from one point to another. Transportation Law covers transportation contracts, liability of transportation companies, transportation insurance and other issues related to transportation. Transportation Law includes separate rules for different types of transportation such as air, land, sea and rail. These rules determine the rights and obligations of transportation companies, cargo owners and passengers.

Transportation Law has gained importance with the development of international trade. In international trade, the transportation of goods or services must be carried out in accordance with the legal systems and commercial practices of various countries. Therefore, international transportation contracts and compliance with these contracts are one of the most important issues of Transportation Law.

Provisions regarding Transportation Law; The CMR Convention, to which Türkiye is a party, is regulated in the fourth book of the Turkish Commercial Code No. 6102, titled “Transportation Affairs”, and the fifth book, titled “Maritime Trade”. In general, the scope of application of regulations regarding Transportation Law includes the establishment of the transportation contract, the transport document, the carrier’s liability, limitation of the carrier’s liability, removal of the carrier’s liability, termination of the carrier’s liability, the carrier’s receivables, the carrier’s right of recourse, the carrier’s auxiliary persons and liability, the statute of limitations in transportation works, limitation periods in transportation works, the competent court and arbitration board in transportation works.
